# AI Usage Limited Liability Agreement

This AI Usage Limited Liability Agreement ("AI Agreement") governs use of AI-powered features in GlycoSense ("AI Features"). It supplements the Terms of Use, EULA, and Privacy Policy.

By enabling or using AI Features, you agree to this AI Agreement.

## 1. Scope of AI Features

AI Features may include summarization, insights, conversational assistance, drafting support, translation, trend interpretation, or other machine-generated outputs ("AI Output").

## 2. No Professional Advice — Mandatory Medical Practitioner Involvement

AI Output does not constitute medical, legal, or financial advice.

**AI Features are designed to be used exclusively in conjunction with, and under the guidance of, a qualified medical practitioner. You must not rely on AI Output as a substitute for professional medical consultation, diagnosis, or treatment.**

You agree that:
- AI Output is informational only and must be reviewed by a qualified medical practitioner before any clinical or health-related decision is made;
- AI Output may contain errors, omissions, outdated information, or unsafe recommendations;
- you will use AI Features only as a supplement to, and not a replacement for, advice from a licensed medical practitioner;
- all clinically relevant decisions must be reviewed and approved by a qualified medical professional before action is taken.

## 3. Prohibited Uses

You must not use AI Features:
- for autonomous medical diagnosis or treatment decisions without review by a qualified medical practitioner;
- for emergency triage or life-critical decisions without qualified clinician oversight;
- as a sole or primary basis for any health, medication, or lifestyle decision;
- to generate unlawful, harmful, discriminatory, abusive, or deceptive content;
- to violate applicable healthcare, privacy, or medical device regulations.

## 4. User Responsibility and Verification

You are solely responsible for:
- validating AI Output before reliance;
- professional review where appropriate;
- downstream actions taken by you, your staff, or your organization based on AI Output.

## 5. Data Handling for AI

Depending on configuration, prompts and related metadata may be processed by on-device models and/or approved service providers to generate responses.

Do not input third-party confidential or sensitive data unless you have legal authority and a valid basis to process and share that data.

## 6. AI Performance Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI FEATURES AND AI OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ACCURACY, COMPLETENESS, RELIABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

## 7. Zero Liability for AI Features

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS AFFILIATES, LICENSORS, VENDORS, AND SERVICE PROVIDERS BEAR ABSOLUTELY NO LIABILITY OF ANY KIND FOR:
- ANY CLINICAL, MEDICAL, HEALTH, OR OPERATIONAL DECISIONS MADE USING OR IN RELIANCE ON AI OUTPUT;
- ANY HARM, INJURY, LOSS, OR DAMAGE — WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE — ARISING FROM USE OF AI FEATURES;
- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION;
- CLAIMS ARISING FROM USER FAILURE TO CONSULT A QUALIFIED MEDICAL PRACTITIONER BEFORE ACTING ON AI OUTPUT;
- CLAIMS ARISING FROM USER FAILURE TO VERIFY OR VALIDATE AI OUTPUT;
- ANY CONSEQUENCE OF USING AI FEATURES WITHOUT CONCURRENT MEDICAL PRACTITIONER OVERSIGHT.

THE COMPANY PROVIDES AI FEATURES AS AN INFORMATIONAL TOOL ONLY. THE ENTIRE RISK OF USE OF AI FEATURES AND RELIANCE ON AI OUTPUT RESTS SOLELY WITH YOU. BY USING AI FEATURES, YOU EXPLICITLY ASSUME ALL RISK AND WAIVE ALL CLAIMS AGAINST THE COMPANY TO THE FULLEST EXTENT PERMITTED BY LAW.

WHERE APPLICABLE LAW DOES NOT PERMIT COMPLETE EXCLUSION OF LIABILITY, THE COMPANY'S TOTAL AGGREGATE LIABILITY ARISING FROM AI FEATURES WILL NOT EXCEED INR 1,000 (ONE THOUSAND INDIAN RUPEES) OR THE EQUIVALENT IN LOCAL CURRENCY.

Nothing in this agreement excludes liability that cannot legally be excluded under mandatory applicable law.

## 8. Assumption of Risk

You acknowledge and accept:
- the inherent risks of probabilistic AI systems, including hallucinations, false positives/negatives, bias, and context misinterpretation;
- that AI Features are not a substitute for a qualified medical practitioner's assessment, diagnosis, or treatment;
- that you are solely responsible for ensuring any use of AI Features is supervised or reviewed by a licensed medical practitioner;
- that the Company has no obligation or duty of care with respect to health outcomes arising from your use of AI Features.

## 9. Indemnification

You agree to defend, indemnify, and hold harmless the Company and related parties against claims arising from:
- your breach of this AI Agreement;
- reliance on unverified AI Output;
- unlawful or unauthorized use of AI Features.

## 10. Suspension and Access Controls

We may limit, suspend, or disable AI Features for safety, compliance, legal, security, or abuse-prevention reasons.

## 11. Regulatory Notice

AI Features are not intended to be a regulated medical device functionality unless explicitly labeled and approved as such in your jurisdiction.

## 12. Priority and Conflict

If there is a conflict between this AI Agreement and general Terms regarding AI use, this AI Agreement controls for AI Features.

## 13. Governing Law

This AI Agreement is governed by the laws and dispute-resolution terms set out in Terms of Use, unless local mandatory law requires otherwise.
