# End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between you ("you" or "User") and Telestratum Networks Pvt Ltd, with registered address at 7th floor, East Wing, Raheja towers, 26/27, MG Road, Banglore 560001 KA India ("Company", "we", "us", or "our"), governing your use of the GlycoSense mobile application, including updates, upgrades, content, and related services (collectively, the "App").

By downloading, installing, or using the App, you agree to this EULA.

## 1. License Grant

Subject to this EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of the App on devices you own or control for your personal, non-commercial use, unless otherwise agreed in writing.

## 2. Restrictions

You agree not to:
- copy, modify, adapt, translate, or create derivative works of the App;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, except as expressly permitted by applicable law;
- remove or alter proprietary notices;
- use the App in violation of law, regulation, or third-party rights;
- use the App to provide medical diagnosis or treatment in place of licensed medical professionals;
- use automated means to access or extract App data except as explicitly permitted.

## 3. Ownership

The App, including all intellectual property rights, is and remains the exclusive property of the Company and its licensors. This EULA does not transfer ownership rights.

## 4. Open Source Components

The App may include open-source software components. Those components are licensed under their applicable open-source licenses, provided in `Open Source Notices`. In case of conflict for an open-source component, its open-source license controls that component.

## 5. Health and Safety Notice

The App provides wellness and health-support functionality and is not a substitute for professional medical judgment, diagnosis, or treatment. In an emergency, call local emergency services immediately.

## 6. Data and Privacy

Your use of the App is subject to the Privacy Policy, available at https://glycosense.com/privacy-policy. By using the App, you acknowledge and agree to privacy practices described there.

## 7. Updates and Changes

We may provide updates, patches, or upgrades. Certain features may stop functioning properly without updates. We may modify or discontinue features as permitted by law.

## 8. Third-Party Services

The App may interoperate with third-party services (for example, device integrations, health platform APIs, cloud infrastructure, authentication providers, and analytics providers). Your use of third-party services is subject to their terms and privacy policies.

## 9. Term and Termination

This EULA is effective when you first use the App and continues until terminated. We may suspend or terminate this EULA if you breach its terms. Upon termination, you must stop using and delete the App, except where retention is required by law.

## 10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted or error-free operation, or that defects will always be corrected.

## 11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE APP.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY BEARS NO LIABILITY FOR ANY CLAIM RELATING TO THE APP.

Nothing in this EULA excludes liability that cannot be excluded under applicable law.

## 12. Indemnification

You agree to indemnify and hold harmless the Company and its affiliates from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the App, violation of this EULA, or violation of law.

## 13. Export and Sanctions Compliance

You represent that you are not located in a restricted jurisdiction and are not prohibited from receiving the App under applicable export control or sanctions laws.

## 14. Governing Law and Dispute Resolution

This EULA is governed by the laws of THE REPUBLIC OF INDIA, excluding conflict-of-law rules. Any dispute will be resolved in the courts of BENGALURU, INDIA, unless mandatory law requires otherwise.

## 15. App Store Terms

If you downloaded the App from Apple App Store or Google Play, you acknowledge:
- this EULA is between you and the Company, not with Apple or Google;
- Apple and Google have no obligation to provide maintenance or support for the App;
- Apple and Google are third-party beneficiaries of this EULA solely as applicable under their store terms.

## 16. Entire Agreement

This EULA, together with the Terms of Use and Privacy Policy, constitutes the entire agreement between you and the Company regarding the App.
