Terms and Conditions for using GlycoSense

Please read these Terms and Conditions ("Terms") carefully before using the GlycoSense mobile application ("App," "Service," "we," "us," or "our").

By accessing or using GlycoSense, you ("User," "you," or "your") agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

GlycoSense is a healthcare-related mobile application that provides information and tools related to glucose monitoring and diabetes management. The App may include features such as data tracking, informational content, and general health insights.

IMPORTANT: The information provided through GlycoSense is for informational and educational purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

• The App does not provide medical advice, diagnoses, or treatment recommendations
• Information displayed in the App should not be considered or used as medical advice unless confirmed by a qualified healthcare professional
• You should always seek the advice of your physician or other qualified health provider with any questions regarding a medical condition
• Never disregard professional medical advice or delay seeking it because of information you have accessed through the App

GlycoSense is not a medical device and has not been evaluated or approved by any regulatory authority for medical use. The App is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

If you are experiencing a medical emergency, call your local emergency number immediately. Do not rely on the App for emergency medical assistance.

You agree to:

• Consult with qualified healthcare professionals before making any medical decisions
• Discuss any information from the App with your doctor or healthcare provider
• Continue all prescribed medical treatments and follow your healthcare provider's advice
• Inform your healthcare provider about your use of the App

You are responsible for providing accurate and complete information when using the App. Inaccurate data may result in incorrect outputs or insights.

You must be at least 18 years of age to use GlycoSense, or have permission from a parent or legal guardian if you are under 18.

Your health information is sensitive. Our collection, use, and protection of your personal and health data are governed by our Privacy Policy, which is incorporated into these Terms by reference.

While we implement reasonable security measures to protect your information, no method of transmission over the internet is completely secure. You acknowledge and accept the inherent security risks of providing information online.

All content, features, and functionality of GlycoSense, including but not limited to text, graphics, logos, and software, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any portion of the App
• Interfere with or disrupt the App or servers connected to the App
• Use the App to transmit any malicious code, viruses, or harmful content
• Reverse engineer, decompile, or disassemble any aspect of the App
• Use the App in any way that could damage, disable, or impair the Service

The App may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third-party sites. Your use of third-party services is at your own risk and subject to their terms and conditions.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected

In no event shall GlycoSense, its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, or similar issues transmitted to or through the App
• Any errors or omissions in content or information
• Any decisions made or actions taken based on information provided through the App

You expressly acknowledge and agree that we shall not be liable for any health outcomes, medical decisions, or health-related consequences arising from your use of the App.

You agree to indemnify, defend, and hold harmless GlycoSense and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any medical decisions or actions you take based on information from the App

We reserve the right to modify, suspend, or discontinue the App or any features thereof at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms in the App and updating the "Last Updated" date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

You may stop using the App and delete your account at any time.

We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

These Terms shall be governed by and construed in accordance with the laws of Bengaluru, India, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, India.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GlycoSense regarding the use of the App and supersede any prior agreements.
